'ECPD' Application Terms of Use Policy

Effective Date: August 29, 2024

1. Acceptance of Terms

By downloading, installing, and using the Eau Claire Police Department’s cell phone application (“ECPD”), you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Use of the App

The App is intended to provide users with access to information and services related to the Eau Claire Police Department. You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the App.

3. User Conduct

You agree not to:

Use the App in any way that could damage, disable, overburden, or impair the App or interfere with any other party’s use of the App.

Attempt to gain unauthorized access to any part of the App, other accounts, computer systems, or networks connected to the App.

Use any automated means to access the App for any purpose without our express written permission.

Use the App to transmit any unlawful, threatening, defamatory, obscene, or otherwise objectionable material.

4. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of the Eau Claire Police Department and are protected by copyright, trademark, and other intellectual property laws.

5. Privacy

Your use of the App is also governed by our Privacy Policy, which can be found here. By using the App, you consent to the collection and use of your information as outlined in the Privacy Policy.

6. Disclaimers

The App is provided on an “as is” and “as available” basis. The Eau Claire Police Department makes no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, or materials included on the App. To the full extent permissible by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

7. Limitation of Liability

The Eau Claire Police Department will not be liable for any damages of any kind arising from the use of the App, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

8. Changes to Terms

We may update these Terms of Use from time to time. We will notify you of any changes by posting the new Terms of Use on the App. You are advised to review these Terms of Use periodically for any changes.

9. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of Wisconsin, without regard to its conflict of law principles.
